Terms of Service

Welcome to PrismScan ("we," "us," or "our"), a mobile application (the "App") and associated proprietary receiving program that provide QR code and barcode scanning services, including a keyboard extension and optional data transfer features. These Terms of Service ("Terms") govern your use of the App and the proprietary receiving program (collectively, the "Service"). The Service is offered free with advertisements, with optional in-app purchases to remove ads or unlock additional features. By installing or using the Service, you agree to these Terms.

1. Acceptance of Terms

By installing or using the App or the proprietary receiving program, you agree to be bound by these Terms. If you do not agree, please uninstall the App and cease using the receiving program.

2. License and Usage

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal and work-related purposes, subject to these Terms. This license includes the App and the proprietary receiving program used for transferring scan results via Wi-Fi within your local network. You may not:

• Modify, reverse-engineer, decompile, or distribute the App or receiving program.
• Use the Service for illegal or unauthorized purposes.
• Interfere with the Service’s functionality, security, or performance.
• Attempt to intercept or misuse data transferred via Wi-Fi within your local network.
• Use the Service for commercial development, resale, or integration into other products without our prior written consent.

You are responsible for ensuring your local network is secure when using the Wi-Fi transfer feature.

3. User Content

You are responsible for any content you scan or add as notes within the App, including content transferred to a computer via Wi-Fi using our proprietary receiving program. We do not claim ownership of your content but may process it to provide the Service’s features, such as scanning, storing, and transferring data. You grant us a non-exclusive, worldwide, royalty-free license to process your content solely to provide and improve the Service. You are responsible for the security and use of your content after it is transferred to your computer.

4. In-App Purchases and Advertisements

The Service is offered free of charge with advertisements provided by Google AdMob. You may make in-app purchases to remove ads or unlock additional features. All purchases are subject to the payment terms of the respective app store (e.g., Google Play, Apple App Store). Advertisements may involve data collection by third parties, as described in our Privacy Policy at Privacy Policy.

5. Termination

We may terminate or suspend your access to the Service at our sole discretion, without notice, if you violate these Terms, including misuse of the App, receiving program, or Wi-Fi transfer feature. Upon termination, your license to use the Service ends, and you must uninstall the App and cease using the receiving program.

6. Disclaimer of Warranties

The Service, including the App and proprietary receiving program, is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data transferred to your computer via Wi-Fi will remain secure after transfer.

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to issues related to the security of your local network, misuse of the receiving program, or data transferred to your computer. Our total liability for any claim arising from the Service will not exceed the amount you paid for in-app purchases, if any.

8. Changes to Terms

We may update these Terms periodically. Changes will be posted here with an updated date, and continued use of the Service constitutes acceptance of the revised Terms.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Taiwan (Republic of China), without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through informal negotiation. If negotiation fails, disputes will be submitted to binding arbitration in Taipei, Taiwan, conducted under the rules of the Chinese Arbitration Association, Taipei, except for claims that qualify for small claims court.
